Part A of these terms and conditions applies to the purchase by consumers of Nike gift cards, including both physical and digital gift cards on Nike-owned platforms such as Nike.com and/or at any of the Nike-owned stores which may offer gift cards ("Nike gift card(s)"). We strongly recommend that you read these terms carefully before you purchase a gift card. The purchase of gift cards through other means such as third-party platforms or stores will be subject to those third-party's terms of purchase, and Part A of these terms and conditions shall not apply ("Nike gift cards bought from third parties").

Part B of these terms and conditions applies to the use of both Nike gift cards and Nike gift cards bought from third parties (collectively the "gift card(s)"). By purchasing your Nike gift card and/or by using your Nike gift cards bought from third parties, you agree to be bound by Part B of these terms and conditions.

Nike may amend these terms and conditions from time to time if necessary to comply with applicable laws, to adapt these terms and conditions to Nike's sales models and/or for technical reasons. Your purchase of a Nike gift card or your use of a Nike gift card bought from third parties will be subject to the terms in force at the time of purchase, unless the applicable law dictates otherwise. If any of these terms and conditions are deemed invalid, void or for any reason unenforceable, that term shall be deemed severable and will not affect the validity and enforceability of any remaining terms or conditions.

PURCHASING A NIKE GIFT CARD

You can purchase Nike gift cards in digital format, online at Nike.com and on select Nike-owned platforms in the following countries/regions: Austria, Belgium, France, Germany, Ireland, Italy, the Netherlands, Spain and the United Kingdom.

You can purchase Nike gift cards in physical format, online at Nike.com and on select Nike-owned platforms in the following countries/regions: Austria, Belgium, Czech Republic, Denmark, Finland, France, Greece, Germany, Hungary, Ireland, Italy, Luxembourg, the Netherlands, Poland, Portugal, Slovenia, Spain, Sweden and the United Kingdom.

Physical Nike gift cards are also available for purchase at select Nike-owned stores in the following countries/regions: Austria, Belgium, France, Germany, Ireland, Italy, the Netherlands, Portugal, Spain and the United Kingdom. You cannot purchase more than ten (10) Nike gift cards in physical format or more than ten (10) Nike gift cards in digital format in any one transaction. Nike gift cards in physical format cannot be purchased with a balance of less than five (5) Euros and cannot be loaded with a balance of more than five hundred (500) Euros. Nike gift cards in digital format cannot be purchased with a balance of less than five (5) Euros and cannot be loaded with a balance of more than four hundred (400) Euros.

Once your order has been approved, you will receive a confirmation email ("order confirmation"). We recommend that you print or download a copy of these T&Cs and Terms of Sale and the relevant Order Confirmation for future reference.

For Nike gift cards in physical format, the Order Confirmation will include an estimated delivery date. Once the order has been dispatched, you will be able to track the delivery directly with the courier and have an exact date of delivery.

Nike gift cards in physical format purchased on Nike.com and on select Nike-owned platforms for delivery by post will be dispatched with express delivery (2 to 5 working days), free of charge. Nike gift cards in digital format purchased on Nike.com and on select Nike-owned platforms for delivery via email will be sent to the email address provided at the time of ordering.

Nike reserves the right to refuse, cancel or hold for review orders made for Nike gift cards in case of suspected fraud, and cards mistakenly issued in an incorrect denomination, cards obtained through unlawful means, or for other violations of Nike gift card terms and conditions.

CONSUMER RIGHT OF WITHDRAWAL

You have the right to withdraw from the purchase and may return a Nike gift card bought at Nike-owned platforms without indicating any reason within 14 working days of receipt, provided that you have not used the Nike gift card.

To exercise the right of withdrawal, you must inform us of your decision to withdraw from this contract by an unequivocal statement. See the help section on the website.

In case of withdrawal, Nike will refund the amount of the Nike gift card to the original payment method used during ordering within 14 days of the notice of withdrawal. Please contact us to return your Nike gift card if you have further questions. You must provide us with proof of purchase to enable Nike to refund the amount of the Nike gift card. For Nike gift cards bought online, you can find the receipt for your purchase attached to the purchase confirmation email. There is no need for you to send your Nike gift card back to us.

Nike gift cards purchased at a Nike Store (brick-and-mortar store) cannot be returned even if they have not been used.

REDEEMING A GIFT CARD

You can use your gift card online at Nike.com and in the Nike App towards the purchase of all goods (except for purchasing Nike gift cards) and services available in any of the following countries/regions: Austria, Belgium, Czech Republic, Denmark, Finland, France, Greece, Germany, Hungary, Ireland, Italy, Luxembourg, the Netherlands, Poland, Portugal, Slovenia, Spain, Sweden and the United Kingdom.

Gift cards in physical format can also be used in select Nike-owned stores in Austria, Belgium, France, Germany, Ireland, Italy, the Netherlands, Portugal, Spain and the United Kingdom. Please note that not all Nike-owned stores accept gift cards in physical format as payment. Use our store locator to check if stores near you accept gift cards. All purchases made with gift cards at Nike.com are subject to the acceptance of our Terms of Sale for online purchasing. You acknowledge that you have carefully read such Terms of Sale and agree to fully comply with them.

Except for the provisions on refunds and returns outlined below, purchases made using gift cards at Nike-owned stores are subject to the same general purchase terms and conditions as any item purchased at a Nike store.

Gift cards can be used as many times and for as many purchases as you choose until the total balance of the gift card has been spent. However, upon the partial redemption of a gift card, any unused balance will be carried over for future purchases and cannot be redeemed or exchanged for cash.

You cannot exchange your gift card balance for cash or use the balance of the gift card to purchase another Nike gift card.

You may add additional funds (subject to the maximum balance limits set out above) to gift cards in physical format.

Gift cards are not for resale. Gift cards are for personal use only and shall not be used for advertising or promoting items or services.

EXPIRY

Your gift card has no expiry date.

VIEW BALANCE

You can check your gift card balance online.

MULTIPLE PAYMENT METHODS

The total order value for products purchased online or in store with a gift card includes (i) the price of the product(s); (ii) value-added tax where applicable; and (iii) delivery charges where applicable. If the order total is more than the balance on your gift card, the remaining sum must be paid for by another accepted payment method (which may include another gift card). No more than 10 gift cards can be used for any one transaction.

The gift card balance will immediately be reduced following purchase, while the credit card or PayPal account will not be charged until the items are dispatched.

REFUNDS FOR PURCHASES MADE WITH A GIFT CARD

If you return a product originally purchased with a gift card, any refund due to you will be returned to the gift card used or to a new Nike gift card where the original gift card cannot be located. If you return a product originally purchased with multiple gift cards or Nike gift cards, the total refund due will be returned to the most recently purchased gift card or Nike gift card or to a new Nike gift card where none of the original gift cards or Nike gift cards can be located.

If you return a product originally purchased with multiple payment methods, any refund due will first be refunded to the non-gift card payment method(s) used for the original transaction (e.g. credit card, debit card or PayPal account) up to the original amount due to that payment method, following which any remaining refund balance will be transferred to the gift card used for the original transaction or to a new Nike gift card where the original gift card cannot be located.

LOST, STOLEN OR DAMAGED GIFT CARDS

Title and risk of loss for gift cards pass to the purchaser upon our electronic transmission of the gift card to the purchaser or the designated recipient, our delivery to you, or at the time the gift card is handed over to you for in-person transactions, whichever is applicable. Gift cards must be obtained from Nike or an authorised third party. You are responsible for safeguarding your gift card from unauthorised use. Nike will not be responsible if any gift card is lost, stolen, destroyed or used without your permission. Nike is not responsible for, and assumes no liability to you, for any unlawful conduct or fraud by any third party associated with any gift card.

We have no obligation to replace your gift card in the event it is lost, damaged or stolen. Nike cannot replace your gift card without proper proof of purchase if it is lost, stolen or damaged. Nike cannot be held responsible for any balance lost on a gift card as a result of loss, theft or fraud. You can request the cancellation of your gift card if it is lost or stolen to ensure that the unauthorised holder can no longer use it. If cancellation of the original gift card is possible, Nike will replace your gift card with the amount that remained when cancelled. Please contact us for more information.

NIKE CANCELLATION

Additionally, if you violate these terms and conditions, or if Nike has reasonable grounds to suspect that a gift card was obtained, used or applied to a purchase fraudulently, unlawfully or otherwise in violation of these terms and conditions, or any gift card is used in a manner that Nike has reasonable grounds to suspect is unlawful or fraudulent, misleading, deceptive, unfair or otherwise harmful to Nike, its affiliates or its customers, Nike reserves the right, without notice to you, to cancel, hold, void or refuse to accept such gift card without issuing a refund, suspend or terminate accounts, suspend or terminate the ability to use our services, cancel or limit orders, and bill alternative forms of payment.

CHOICE OF LAW/JURISDICTION

Except where prohibited and without limitation to any consumer protection rights that you may be entitled to under the mandatory laws of your country of residence. You agree that these terms and conditions and any dispute between you and NIKE shall be governed in all respects by Dutch law.

Except where prohibited and without limitation to any statutory rights for consumers, you agree that all disputes, claims and legal proceedings directly or indirectly arising out of the purchase and use of the gift cards and the use of gift cards bought from third parties shall be resolved individually, without resort to any form of class action, in the competent courts of Amsterdam, the Netherlands. These terms and conditions will not limit any consumer protection rights that you may be entitled to under the mandatory laws of your country of residence and if you do not live in the Netherlands, you will be able to bring a claim in the courts of your country of residence under the applicable laws of your country of residence.
